“”The recent decision in autoownersinsurance.com is a perfect example of things going from worse to horrible.  While the decision itself contains many substantive flaws, my overwhelming issue is with the lack of due-process rights evidenced by this UDRP.

The complaint was limited to a 3-paragraph argument which asserted a USPTO registration for “Auto-Owners”.  The complaint asserted lack of legitimate interest because the domain was used in PPC and included links to insurance (surprise).  The complaint did not allege bad faith registration and allegations of bad faith use were limited to the same PPC argument.

The timely response explained that the mark was a “design” mark obtained under 2(f).  For those unfamiliar, a 2(f) application is required when a mark is not “distinctive”.  The registration is granted based on the ex-parte submissions of the applicant.    “Ex-parte” means that no one is allowed to challenge the application.  We argued the domain was not identical or confusingly similar given the additional descriptive term which substantially expanded upon the mark.  We noted that while the complainant alleged common law trademark rights in “auto owners insurance”, there was not one scintilla of evidence (not even a hair) supporting the claim.

Complainant’s legitimate interest and bad faith claims were limited to the fact insurance links appeared on the PPC page.   The PPC results for insurance were hardly surprising since the domain was inherently descriptive.  Insurance is after all required in most places and of obvious interest to “auto owners”.

On the February 14^th respondent received Complainant’s supplemental filing (“CSF”) which my email records showed to have been filed late.  The CSF included 13 pages of argument and 9 new exhibits covering 191 pages, representing over 7.3 MEGABYTES of data.  The CSF substantially amended the original complaint and for the first time included evidence supporting a common law trademark claim.  Respondent started preparing a reply which was set for filing on the night of the 21^st.  Just prior to filing, Respondents received a decision dated February 21^st!  The decision makes it clear that the entirety of the CSF was considered by the panel.  The decision does not even discuss the propriety of the CSF.…

In the PR Manwin says that the amended complaint drops two related state law claims against ICM and ICANN.

“While Manwin believes that it would have prevailed on the two state law claims, those claims involved procedural peculiarities of California law that posed risks of potential trial delay. Manwin is anxious to have its day in court and did not want any such delay.”

“The filing of an amended complaint in our antitrust case was required to avoid unnecessary procedural delays by ICM and ICANN,” said Kevin E. The last sentence of the PR certainly doesn’t match the the sentiment in Manwin’s Court filings on Valentines Day that expressed that settlement talks were underway and that “” The parties believe that additional time would potentially allow the parties to resolve all or some portion of their dispute”

Jets.com sold for $375,000 through Sedo.com in 2009

I came across the servers SPAM-AND-ABUSE.COM on which the domain name Jotform.com was placed on a few days ago and then removed from on Friday.

According to DailyChanges.com, There are currently over 225,000 domain names on the servers SPAM-AND-ABUSE.COM (you might also see the servers listed as ns1.suspended-for.spam-and-abuse.com)

The domain name SPAM-AND-ABUSE.COM is owned by Godaddy.com

The domain name SPAM-AND-ABUSE.COM does not resolve, so if a domain name is moved to the servers the domain and site will no longer resolve and of course any email directed to the domain will bounce.

Out of the 225,000 domain names placed on these servers, 212K are .info domains or about 90%.

It looks just by those numbers that a substantial  portion of the domains placed on these servers are there for a good reason.

I reached out to Godaddy.com and asked about these servers; how domains get moved to the servers and how a domain holder can gets it domain name moved off these servers back to its normal servers and make their site and email operational again.

I also asked if the domain name once moved to these servers where locked at the registrar level or could be transferred to another registrar.

To the great credit of Godaddy and while I certainly didn’t expect a response during a holiday weekend I got one.

Actually I got several.

Ben Butler,  Director of Network Abuse for Godaddy explained the process as follows:

“”You probably know Go Daddy has a long history of addressing abusive practices on its network.”

” While we don’t “police” or “monitor” our systems for these activities (nor could we due to the prohibitively large scope of such an effort), we do receive many thousands of complaints every month on a variety of abusive practices such as spam, phishing, malware installers, and so on.”

“We investigate each complaint that comes in.”

“Those investigations sometimes demonstrate a need to re-direct the DNS of an abusive domain name in order to prevent further harm.  (For example, an extra hour of up-time for a phisher can result in thousands of identities being stolen, so time is of the essence in many cases.) ”

“Domains pointed at the name servers you listed will not resolve unless and until the underlying issue is addressed by the registrant.  Redirection of the DNS can also sometimes be combined with a “hold” status that would remain in effect until the customer can address the problem with our 24×7 Abuse Response Team.”
